4th Amendment !



"The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized".





I find it interesting that the Yankee paper calls it murder.

  1. Amen brother! One of many of the Lincoln Administration's squashing of the Constitution! The current occupant of the White House learned well from him - after all, he has stated that Lincoln is is mentor. No surprises there!

  2. Sort of an interesting argument here. You and Stan are standing by Constitutional rights, but the South intended to throw off the Constitution and create a new one. So the 4th Amendment either applied to them as citizens, or it did not.

    # 1 If Ellsworth saw Virginia as "not" having left the Union he violated the 4th !
    # 2 If he saw it as Virginia "had"left the Union he still had no right to barge in and remove the Flag. He was on foreign soil and had no authority what so ever.

  4. #3, he is ordered to quarrel an armed rebellion, the flag being an obvious symbol of that rebellion.

    Note on # 2: If he was at war with said "country", rights aside, entering the house is merely a matter of force. That is not to say that either occurred here.
